Terms & Conditions

This is the user agreement which governs your use of this website and the purchase by you of the services and products we provide.

The platform is owned and operated by Open Access Key Ltd., a registered company Reg. Number 502509, Fitzwilliam Hall, Fitzwilliam Place, Dublin 2, Ireland.

However the publication services of the articles are supplied by third party publishers, therefore the contract for the article publication will be between you and that third party publisher. openaccesskey play no role in the decision to publish or reject the publication of each article. This decision is solely the responsible of the editorial process of the publisher.

1. Please take time to read these terms and conditions it is important for both of us that you understand our contractual relationship relating to your use of the openaccesskey platform. We will not allow you to manage your publication payments using the openaccesskey platform unless you have confirmed that you have read these terms.

2. openaccesskey operates to an agency model. This means that we act as a disclosed agent for third party suppliers, such as an academic publisher. What this means is that the publication of your article is between you and the publisher. In most cases this will mean that you will have entered into additional terms and conditions and copyright licence governing the process of publication as each publisher will have terms and conditions relating to that process. Please make sure that you have read these terms and conditions before completing your transaction with us. You can easily request them from our Customer Services by using one of the methods detailed at the end of these terms. Where we act as agent this will mean that we have no contractual liability to you in respect of that product. However, we may still be liable to you if we have been negligent; we have misrepresented important information or have been in breach of any other relevant law.

3. All payments processed through the openaccesskey platform are not an offer by openaccesskey to organise the publication of your article, but an invitation to you to make the publication payment to the relevant publisher. Once we have processed your publication payment, you will receive confirmation and also be able to see the confirmed payment in your online account. If you require any further confirmation or documentation, please do not hesitate to contact Customer Services.

4. Once openaccesskey has received your article publication payment in full, it takes responsibility to pass the fee to the relevant publisher using the most appropriate procedures provided by the publishers. Openaccesskey provide payments promptly to publishers and will be made in a timely fashion that will not delay the publication of the article.

5. Because the publication of the article is between you and the publisher any queries or concerns relating to the article should be addressed to them. We will of course assist you with this if you wish - please contact Customer Services.

6. You undertake to us that the details you give to us while using the openaccesskey platform are correct in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the product or service.

7. If you request the article publication payment to be made by your university and funder, we may have to communicate with you directly to fulfil certain registration criteria required by these organisations. Please provide full information required to process your payment, details can be delivered by Customer Services or your Central Account Manager at your University – contact details we can provide.

8. If you seek payment by your university or funder and they choose to reject your application, we will act to provide you with the details of their decision. It maybe that they require you to complete further details. Any rejection decision is made by your university of funder and representations to OAK will make no difference to the decision.

9. If you are the corresponding author and wish to manage the article publication payment by splitting the fee between your co-authors using the openaccesskey platform, please do this with prior communication with your co-authors. Any split payment not made will be the final responsibility of the corresponding author. Openaccesskey will communicate with the corresponding author to conclude the payment of any outstanding balance.

10. If there are any changes to the details supplied to us by you it is your responsibility to inform openaccesskey via our web form or by contacting our Customer Services as soon as possible.

11. We won't send you e-mails which you do not want.

12. We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the sophisticated technology that is required in operating openaccesskey there may be times when obvious errors occur. For example, very occasionally, this may result in a price, product or service or other detail displayed or presented on the platform being incorrect. In this case we reserve the right to cancel that article publication payment, but this of course will be without any liability to you.

13. openaccesskey does not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties.

14. Credit card companies charge us a fee when you pay with their cards and therefore a credit card fee is applied to some article payments made with Visa, MasterCard, Paypal or other listed credit cards.

15. By registering or placing an order on this website, you consent to the collection, use and transfer of your information under the terms of this policy.

16. When you visit, register or order products or services on this website you may be asked to provide certain information about yourself including your name, contact details and credit or debit card information. We may also collect information about your usage of our website as well as information about you from messages you post to the website and e-mail or letters you send to us. To maintain customer service standards and to assist staff training, we may record and monitor incoming calls.

17. Your information will enable us to provide you with access to all parts of our website and to supply the goods or services you have requested. It will also enable us to bill you and to contact you where necessary concerning your orders. We will also use and analyse the information we collect so that we can administer, support, improve and develop our business. In particular, we may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to the website or our services. Further, where you have consented, we might also use your information to let you know by e-mail or post about other products and services which we offer which may be of interest to you. If you change your mind about being contacted in the future, please let us know and we'll make sure you're not contacted for these purposes again.

The information you provide to us may be accessed by or given to third parties some of whom may be located outside the European Economic Area who act for us for the purposes set out in this policy or for other purposes approved by you. Those parties process information, fulfil and deliver orders, process credit card payments and provide support services on our behalf. We may also pass aggregate information on the usage of our website to third parties but this will not include information that can be used to identify you.

19. Where you have consented when providing us with your details, we may also allow other companies in the Open Access Key, to contact you occasionally about products and services which may be of interest to you. They may contact you by e-mail. If you change your mind about being contacted by these companies in the future, please let us know and we'll make sure you're not contacted for these purposes again.

20. If our business enters into a joint venture with or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners.

21. Unless required to do so by law, we will not otherwise share, sell or distribute any of the information you provide to us (including your e-mail and postal address) to companies or persons outside the Open Access Key without your consent.
